Acceptance of these terms

These Terms of Service govern your use of MiamiGo, including our website, consumer experience, business portal, offer claiming and redemption tools, and related services. By accessing or using MiamiGo, you agree to these terms. If you do not agree, do not use the service.

What MiamiGo provides

MiamiGo is a discovery and offers platform that helps people find local restaurants, cafés, rooftops, wellness providers, family activities, events, and other experiences. Participating businesses can create profiles and publish offers for consumers to discover and claim.

MiamiGo is a platform, not the provider of the underlying food, activity, event, wellness service, or other venue experience. The participating business is responsible for the products, services, availability, safety, quality, and fulfillment of its offer unless MiamiGo expressly states otherwise.

Accounts

• You must provide accurate information and keep your account details current.
• You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
• Business users must have authority to act for the venue or organization they register.
• We may suspend or terminate accounts involved in fraud, abuse, unlawful activity, impersonation, repeated policy violations, or conduct that risks harm to users, businesses, or MiamiGo.

Offers, claims, and redemptions

Offers may have eligibility rules, time limits, quantity limits, exclusions, redemption instructions, and other conditions shown in MiamiGo or provided by the participating business. Availability is not guaranteed until the venue accepts or redeems the offer as applicable.

Claims and QR codes are personal to the account or transaction that generated them and may not be copied, manipulated, resold, or used fraudulently. A venue may refuse a claim that is expired, already redeemed, altered, inconsistent with stated terms, or reasonably suspected to be fraudulent.

Business listings and content

Business users are responsible for the accuracy, legality, rights, and current status of the information they submit, including venue details, prices, photos, menus, descriptions, promotions, and offer terms. By submitting content, you grant MiamiGo a non-exclusive, worldwide license to host, reproduce, display, format, and distribute that content as needed to operate and promote MiamiGo and the participating venue.

MiamiGo may review, approve, reject, edit for formatting, pause, or remove venue and offer content to protect quality, users, legal compliance, and platform integrity.

Business subscriptions and billing

Some business features require a paid subscription. Prices, billing periods, trial terms, and included features are presented before purchase. Payments are processed by Stripe. By starting a paid subscription, you authorize recurring charges according to the selected plan until the subscription is cancelled.

You can manage billing or cancellation through the available billing portal. Unless otherwise required by law or expressly stated at purchase, fees already charged are non-refundable. Cancellation generally takes effect according to the billing status shown in your account or Stripe portal.

Acceptable use

• Do not misuse MiamiGo, interfere with the service, probe or bypass security, scrape the platform at scale without permission, or attempt unauthorized access.
• Do not upload unlawful, deceptive, infringing, harmful, discriminatory, or malicious content.
• Do not create fake venues, fake claims, misleading promotions, manipulated QR codes, or other fraudulent activity.
• Do not use MiamiGo in a way that violates applicable law or the rights of another person or business.

Third-party services

MiamiGo may rely on or link to third-party services such as payment processors, maps, authentication, hosting, or venue websites. Those services are governed by their own terms and policies. MiamiGo is not responsible for third-party services outside our control.

Disclaimers

MiamiGo is provided on an as-is and as-available basis to the extent permitted by law. We do not guarantee that every listing, offer, price, opening hour, availability statement, venue description, or third-party detail will always be accurate or current. Users should confirm time-sensitive details with the participating business when necessary.

Limitation of liability

To the maximum extent permitted by applicable law, MiamiGo and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from third-party venues, offers, services, business content, unauthorized account access, or interruptions outside our reasonable control. Nothing in these terms excludes liability that cannot legally be excluded.

Changes and termination

We may update MiamiGo, change features, modify these terms, or discontinue portions of the service. Material changes to these terms may be communicated through the service or by other reasonable means. Continued use after an updated effective date means you accept the revised terms, where permitted by law.

Governing law

These terms are governed by the laws of Manitoba and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Courts located in Manitoba will have jurisdiction over disputes that are not required by law to be heard elsewhere.
